1. Agreement to these Terms
1.1 These Terms and Conditions ("Terms") govern your access to and use of the BlendIQ platform, website, and related services ("the Service"), operated by BlendIQ Limited ("BlendIQ", "we", "us").
1.2 By creating an account, ticking the acceptance box at sign-up, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1.3 If you are using the Service on behalf of a company or organisation, you confirm you have authority to bind that organisation, and "you" refers to both you and that organisation.
1.4 The Service is provided for business use by professionals working in land remediation, earthworks, construction materials, and related sectors. It is not intended for consumers.
2. What BlendIQ Is - and Is Not
2.1 BlendIQ is a software tool that assists with the organisation, screening, tracking, and hypothetical blending of soil, aggregate, and construction material data against published standards and user-defined criteria.
2.2 BlendIQ is a decision-support tool only. It does not provide engineering, environmental, legal, or regulatory advice. Outputs from the Service - including screening results, blend calculations, compliance indications, and reports - are computational aids, not professional judgements.
2.3 All outputs must be reviewed, verified, and approved by a suitably qualified and experienced professional before being relied upon for any commercial, engineering, or regulatory purpose.
3. Regulatory Compliance Is Your Responsibility
3.1 Blending, treating, or reusing soils and materials - particularly contaminated or potentially contaminated materials - is a regulated activity in the United Kingdom. Depending on the circumstances, such activities may require environmental permits, permit exemptions, or compliance with regulatory positions and codes of practice (including but not limited to the Environmental Permitting (England and Wales) Regulations 2016, the CL:AIRE Definition of Waste Code of Practice, and Environment Agency guidance).
3.2 You are solely responsible for ensuring that any physical blending, treatment, movement, or reuse of material is lawful, and that all required permits, exemptions, consents, and approvals are in place before any such activity is carried out. BlendIQ assumes, and does not verify, that you hold the correct permissions.
3.3 Dilution is not treatment. The mixing or blending of waste for the purpose of diluting contaminant concentrations to meet waste acceptance criteria, reuse criteria, or any other regulatory threshold is prohibited under Environment Agency guidance and may constitute a criminal offence. The Service's blending functions model the combination of materials for legitimate engineering purposes only. You must not use the Service to plan, justify, or disguise dilution of contaminated material. Any hypothetical blend generated by the Service does not constitute authorisation, justification, or evidence of legality for any physical blending activity.
3.4 BlendIQ accepts no responsibility for your compliance or non-compliance with any law, permit, regulatory position, or guidance. Use of the Service does not transfer any regulatory duty from you to us.
4. Data Quality - Your Inputs Determine Our Outputs
4.1 The Service performs calculations on data you provide, including laboratory results, sample records, tonnages, stockpile information, and uploaded documents.
4.2 Outputs are only as reliable as the data entered. If input data is inaccurate, incomplete, unrepresentative, or improperly obtained - including where samples do not adequately represent the material in question, where sampling frequency or methodology is insufficient, or where laboratory data is misreported or mis-transcribed - the Service's outputs (including hypothetical blends, screening results, and compliance indications) will be correspondingly unreliable.
4.3 You are responsible for the accuracy, completeness, and representativeness of all data entered into the Service, whether entered manually, uploaded, or extracted automatically from documents. Automated extraction (including from PDFs and spreadsheets) must be checked against source documents before reliance.
4.4 Hypothetical blends are mathematical models. Physical materials may behave differently due to heterogeneity, moisture, weathering, segregation, measurement uncertainty, and other real-world factors. A passing hypothetical blend does not guarantee that a physical blend will meet specification or pass laboratory validation.
5. Accounts and Acceptable Use
5.1 You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
5.2 You must not: (a) use the Service for any unlawful purpose, including the planning of unlawful waste activities; (b) attempt to gain unauthorised access to the Service or its data; (c) reverse engineer, copy, or resell the Service; (d) upload malicious code or content you do not have the right to use.
5.3 We may suspend or terminate accounts that breach these Terms.
6. Standards, Screening Values and Third-Party Data
6.1 The Service references published standards, screening values, and specification limits (for example, highway specifications, published screening levels, and waste acceptance criteria). While we take care to reproduce such values accurately and to identify their sources and versions, we do not warrant that any value within the Service is current, complete, or error-free.
6.2 Standards and guidance change. You are responsible for confirming that the version of any standard or screening value applied is the one required by your contract, specification, or regulator.
6.3 Certain datasets may be subject to third-party intellectual property rights and licence conditions. You are responsible for holding any licences required for your use of such data.
7. Intellectual Property
7.1 The Service, its software, design, and content (excluding your data) are owned by BlendIQ Limited or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes while you hold an account.
7.2 You retain ownership of the data you input. You grant us a licence to host, process, and display that data as necessary to provide the Service, and to use anonymised, aggregated data to improve the Service.
7.3 Improving the Service. Data and documents you upload (including laboratory reports and spreadsheets) may be used by BlendIQ Limited internally to test, maintain, and improve the Service - for example, to improve the accuracy of automated document parsing and data extraction. Such use is for internal purposes only: your uploaded data will not be published, shared with, or disclosed to any third party for these purposes.
8. Availability and Changes
8.1 The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation, and we may modify, suspend, or discontinue features at any time.
8.2 We may update these Terms from time to time. Material changes will be notified via the Service or by email. Continued use after changes take effect constitutes acceptance.
9. Disclaimers and Limitation of Liability
9.1 To the maximum extent permitted by law, the Service is provided "as is" and "as seen", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
9.2 BlendIQ Limited shall not be liable for any loss or damage arising from or in connection with: (a) failed, out-of-specification, or rejected batches, blends, or materials; (b) non-compliance with any specification, contract, standard, permit, or law; (c) any regulatory action, enforcement, penalty, prosecution, or loss of permit or accreditation; (d) decisions made, or actions taken or not taken, in reliance on outputs of the Service; (e) inaccurate, incomplete, or unrepresentative input data, howsoever arising; (f) loss of profits, revenue, business, goodwill, or data, or any indirect or consequential loss.
9.3 Subject to clause 9.5, our total aggregate liability to you in any 12-month period shall not exceed the greater of (a) the fees paid by you for the Service in that period, or (b) £100.
9.4 You agree to indemnify BlendIQ Limited against claims, losses, and costs arising from your breach of these Terms, your data, or your use of the Service in connection with any unlawful activity, including unlawful blending or dilution of waste.
9.5 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.
10. Termination
10.1 You may stop using the Service and close your account at any time. We may terminate or suspend access immediately for breach of these Terms, unlawful use, or risk to the Service or other users.
10.2 Clauses which by their nature should survive termination (including clauses 3, 4, 6, 7, 9, and 11) shall survive.
11. General
11.1 These Terms constitute the entire agreement between you and BlendIQ Limited regarding the Service and supersede prior agreements on the subject.
11.2 If any provision is found unenforceable, the remainder shall continue in effect. No waiver of any breach shall be a waiver of any subsequent breach.
11.3 These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
12. Your Data and Privacy
12.1 What personal data we collect, why we process it, who else processes it, where it is held, how long we keep it and what rights you have over it are set out in our Privacy Policy, available at blendiq.co.uk/privacy. The Privacy Policy forms part of your agreement with us.
12.2 BlendIQ is currently a shared workspace. All signed-in users of the platform can see all jobs and the site data within them. You should not upload material you are not content for every user of your BlendIQ installation to see, and you remain responsible under clause 5 for what you upload.
12.3 You are responsible for ensuring you have the right to upload any content containing personal data, including laboratory certificates naming individuals and photographs in which people are identifiable.

By ticking the box at sign-up you confirm that you have read, understood, and agree to these Terms, including the regulatory compliance provisions in clause 3 and the limitations of liability in clause 9.
